Nokturn ("Nokturn", "we", "us" or "our") respects your privacy and is committed to protecting your personal data.

This Privacy Policy explains how we collect, use, store and protect personal data when you visit the Nokturn website, join our waitlist or otherwise interact with us.

This policy currently applies to the Nokturn website and early-access programme. It may be updated before or when the Nokturn mobile application becomes publicly available to reflect additional features such as accounts, location services and in-app activity.

2. What data do we collect?

Depending on how you interact with Nokturn, we may collect the following categories of information.

Waitlist and early access

When you join the Nokturn waitlist, we may collect:

  • your email address;
  • your platform preference, such as iOS or Android;
  • the date and time of your registration;
  • technical information necessary to process and secure the submission;
  • your consent preferences.

Providing your email address is voluntary, but we cannot add you to the waitlist or contact you about early access without it.

Website and technical data

When you access the website, certain technical information may be processed automatically as part of operating, protecting and delivering the website. This may include:

  • IP address;
  • browser and device information;
  • requested pages and resources;
  • timestamps;
  • security and network information;
  • diagnostic information necessary to detect abuse or technical problems.

Some of this information may be processed by our infrastructure providers.

Analytics

Nokturn uses PostHog, when you allow optional analytics, to understand website usage and improve the experience. This includes page views, product demo milestones, waitlist conversion events and masked session replay. We exclude the waitlist form and media from replay and do not send your submitted email address to PostHog.

When analytics are enabled, we may collect information such as:

  • pages or sections viewed;
  • interactions with website features;
  • approximate device and browser characteristics;
  • referring pages;
  • session and interaction information;
  • technical identifiers where required for analytics.

Where applicable law requires consent before analytics technologies are used, those analytics will only be activated after the required consent has been obtained.

We will update this Privacy Policy if our analytics providers or processing practices materially change.

3. Why do we use your data?

We process personal data for the following purposes.

Managing the Nokturn waitlist and early access

We use your email address and platform preference to:

  • register your interest in Nokturn;
  • manage the beta and early-access programme;
  • invite you to TestFlight, Google Play testing or another relevant beta programme;
  • provide information directly related to your registration or access.

The legal basis for this processing is your consent.

Nokturn news and promotional communications

Where you have specifically agreed to receive them, we may send you product announcements, launch information, updates, surveys or other Nokturn communications.

The legal basis for this processing is your consent.

You can withdraw your consent at any time.

Operating and securing the website

We process technical information where necessary to:

  • deliver the website;
  • ensure its reliability and security;
  • prevent abuse, spam and malicious activity;
  • diagnose technical problems.

The legal basis for this processing is our legitimate interest in operating and protecting Nokturn and its infrastructure.

Understanding and improving Nokturn

When analytics are enabled, we may analyse website usage to understand how people interact with Nokturn, improve the website, measure the effectiveness of product experiences and guide product development.

Depending on the analytics configuration and applicable law, this processing may be based on your consent or, where legally permitted, our legitimate interests.

4. Service providers

We use selected service providers to operate Nokturn. These providers may process personal data on our behalf only to the extent necessary to provide their services.

Cloudflare

The Nokturn website uses Cloudflare for web hosting, content delivery, networking, security and related infrastructure services.

Cloudflare may process technical data such as IP addresses, network requests and security information when delivering and protecting the website.

Supabase

We use Supabase as part of Nokturn's backend infrastructure.

For the website, Supabase may store and process information submitted through the Nokturn waitlist, including your email address and platform preference.

Our Supabase infrastructure is configured using the Asia Pacific (Seoul) region for parts of the Nokturn service.

Supabase may also use authorised subprocessors as necessary to provide its services.

5. International data transfers

Some of our service providers or their subprocessors may process personal data outside France or the European Economic Area.

Where personal data is transferred to a country that does not benefit from an adequacy decision under European data protection law, appropriate safeguards are used where required. These may include European Commission Standard Contractual Clauses or another legally recognised transfer mechanism.

Cloudflare and Supabase maintain data-processing terms addressing international data transfers applicable to their services.

The fact that a service is hosted in a particular region does not necessarily mean that no processing can occur elsewhere, for example for support, security, infrastructure or authorised subprocessors.

6. How long do we keep your data?

We keep personal data only for as long as necessary for the purpose for which it was collected.

Waitlist and early-access information

Waitlist information may be retained while the Nokturn early-access programme is active and, where it is also used for communications or prospective customer management, for up to three years from its collection or from your most recent meaningful interaction with Nokturn, unless you withdraw your consent sooner.

If you withdraw consent or ask us to delete your information, we will delete or anonymise the relevant data unless we are required to retain certain information for legal purposes.

We may retain limited information necessary to record that you opted out of communications so that your preference can be respected.

Technical and security data

Technical logs and security information are retained only for periods reasonably necessary for security, diagnostics, fraud prevention and infrastructure operation, subject to the retention settings of the relevant service providers.

Analytics data

Analytics retention periods will be configured according to what is reasonably necessary for product analysis and will be documented as our analytics setup is finalised.

7. Cookies and similar technologies

Nokturn may use cookies, local storage or similar technologies that are technically necessary to operate the website.

We may also use analytics technologies to understand website usage.

Where a technology requires consent under applicable law, it will not be activated until you have given that consent.

You will be able to refuse or withdraw optional analytics consent without losing access to the core website.

Further details may be provided through our cookie preferences interface as analytics are introduced.

8. Your rights

Subject to applicable data protection law, you may have the right to:

  • access the personal data we hold about you;
  • correct inaccurate or incomplete information;
  • request deletion of your personal data;
  • restrict certain processing;
  • object to processing based on legitimate interests;
  • withdraw your consent at any time where processing is based on consent;
  • receive certain personal data in a portable format where applicable;
  • lodge a complaint with a competent data protection authority.

Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

We may need to request information reasonably necessary to verify your identity before responding to certain requests.

If you are located in France, you also have the right to submit a complaint to the Commission Nationale de l'Informatique et des Libertés (CNIL).

9. Marketing communications

We will not send you electronic promotional communications unless we have a valid legal basis to do so.

Where your consent is required, you will be given a clear choice before receiving such communications.

Every promotional email will provide a simple way to unsubscribe.

Operational messages that are strictly necessary to manage an early-access request or beta participation may be treated separately from promotional communications.

10. Security

We use reasonable technical and organisational measures designed to protect personal data against unauthorised access, loss, alteration, disclosure or destruction.

However, no internet-based service can guarantee absolute security.

11. Children

The current Nokturn website and waitlist are not specifically directed at children.

Nokturn is a nightlife discovery product. We do not knowingly seek to collect personal information from children for marketing or beta participation where doing so would be inappropriate or unlawful.

Age-related rules for the Nokturn application may be specified separately before public release.

12. Third-party links

The Nokturn website may contain links to third-party websites or services, including social networks.

Those third parties operate under their own privacy practices. Nokturn is not responsible for how third-party services process personal data after you leave our website.

13. Changes to this Privacy Policy

We may update this Privacy Policy as Nokturn develops, including when we introduce new features, analytics technologies, the mobile application or additional service providers.

The date at the top of this page indicates when it was most recently updated.

If a change materially affects how we use personal data, we will provide additional notice where required by law.
